Professional Experience
Mr. Herbert focuses his practice on products liability, mass tort and medical malpractice defense. Mr. Herbert has extensive trial and appellate experience handling numerous complex litigation matters including high exposure product liability and medical malpractice defense, catastrophic injury and wrongful death claims.
Since joining LeClairRyan in 1998, Mr. Herbert has obtained 25 defense verdicts in 13 separate jurisdictions in Virginia. He has successfully defended high exposure wrongful death cases involving brain and cardiac surgery, permanent disability claims involving obstetrical (shoulder dystocia), gynecological, spinal and ophthalmic surgery and surgeries involving retained objects.
Mr. Herbert’s product liability experience is extensive. He has handled multiple wrongful death and severe injury claims for a variety of manufacturers. He has successfully defended manufacturers and related entities in automobile, aviation, recreational products, medical devices and toy manufacturers. For example, he has represented an automotive manufacturer in a severe rollover case, a gas grill manufacturer in a propane tank explosion case, aviation entities in multiple high exposure wrongful death cases resulting from private plane crashes, and a children’s sled manufacturer in a sledding accident case resulting in quadriplegia.
In the mass tort arena, Mr. Herbert assumed a primary role in the firm’s representation of physicians nationally as liaison counsel for the Fen Phen MDL litigation. He also assisted in the defense of a major distributor in the Latex MDL litigation. Finally, Mr. Herbert has defended numerous retailers, distributors, insurance carriers and manufacturing concerns in contractual disputes, risk management issues, first and third party actions, discovery disputes and declaratory judgment actions.
