Mr. Martineau is a partner at Waller Lansden Dortch & Davis, LLP in Nashville, Tenn. and leads the firm’s Environmental & Regulatory Practice. He represents corporate clients from a wide range of industries in environmental law and regulatory matters. He has extensive experience with the Clean Air Act, and he has worked with numerous companies in the preparation and negotiation of Title V, PSD and other air permitting activities. He represents clients before the EPA, the Tennessee Department of Environment and Conservation, other state agencies and the Tennessee Air Pollution Control Board in commenting on proposed regulations and in administrative proceedings. Mr. Martineau also defends companies in federal and state and citizen suit enforcement proceedings under various environmental statutes, including several companies responding to EPA’s New Source Review (NSR) enforcement initiative. Mr. Martineau was co-editor and contributing author to The Clean Air Act Handbook (ABA Press, 1st ed. 1997, 2nd ed. 2005).
In addition to the Clean Air Act, Mr. Martineau has extensive experience working with companies on corporate environmental management programs and auditing programs, including ISO 14000 programs. He assists clients in resolving environmental issues associated with corporate and real estate transactions, with a particular emphasis on issues regarding the development and siting of projects. He also has extensive experience in addressing employee environmental health and safety issues associated with complex manufacturing facilities.
From 1988 to 1994, Mr. Martineau served as Senior Counsel in the Office of the General Counsel of the United States Environmental Protection Agency in Washington, D.C. He provided counsel in developing NSR, NSPS and Air Toxics regulations. Mr. Martineau also defended the EPA in litigation before the United States Court of Appeals for the District of Columbia Circuit.
